Huawei and Qualcomm Sign a Big Patent Deal: What Does It Mean?

Tags: huawei, ai, patent

On October 5, 2026, two giants of the mobile world, the Chinese company Huawei and the American chip maker Qualcomm, announced a new patent agreement. It may sound like boring legal news, but it says a lot about how the tech industry is changing.

First, what is a patent?

A patent is a legal right. It protects a new invention. If a company owns a patent, other companies need permission to use that idea, and they usually pay money for it. This payment is called a licensing fee.

Modern smartphones use thousands of patented ideas: how the phone connects to 5G, how the chip processes data, how the signal travels. No single company owns all of them. So companies often make deals with each other.

What did Huawei and Qualcomm agree on?

The two companies signed a cross-licensing agreement. “Cross” means it works in both directions: Huawei can use some of Qualcomm’s patents, and Qualcomm can use some of Huawei’s.

Here are the main points:

  • It lasts several years. The exact length was not made public.
  • It covers important technologies: 5G, AI, computing and networking.
  • Qualcomm will buy some of Huawei’s U.S. patents in areas like AI and networking.
  • The financial terms are secret. Neither company shared the price.
  • It is not final yet. U.S. regulators still need to approve the deal.

Both companies said the deal follows FRAND rules. FRAND stands for “fair, reasonable and non-discriminatory”. In simple words, the prices must be fair, and every customer should be treated in the same way.

Why is this deal special?

1. It is the first deal between them that includes 5G. Huawei is one of the biggest contributors to 5G technology. It developed a method called polar codes, which is part of the 5G standard. With this deal, Qualcomm officially recognizes the value of Huawei’s work.

2. The direction of money may have changed. For about 25 years, Huawei paid Qualcomm to use its technology. According to the tech news site TrendForce, this time Qualcomm will be the one paying. The companies have not confirmed this publicly, but if it is true, it is a historic change.

3. It shows that business continues despite politics. Since 2019, the U.S. has placed strong limits, called sanctions, on Huawei. Huawei lost access to many American chips and tools. Because of this, Huawei invested heavily in its own research and built its own chips. This deal suggests that Huawei’s own technology is now valuable enough that even an American rival wants to use it.

A short history

The relationship has not always been friendly:

  • 2001: The two companies signed their first licensing agreement.
  • 2017–2020: Huawei stopped paying Qualcomm for some of its patents, and the two companies disagreed.
  • 2020: They settled the dispute. Huawei paid about $1.8 billion and signed a new deal.
  • 2026: A new, wider agreement, and this time it includes 5G.

What does this mean for everyone else?

For normal users, nothing will change tomorrow. Your phone will work the same way. But in the long term, deals like this matter because:

  • They reduce the risk of legal fights, which can block products from being sold.
  • They help companies share technology instead of building everything from zero.
  • They show that China’s tech companies are becoming important inventors, not just manufacturers.

Conclusion

This agreement is more than a legal document. It shows that Huawei, after years of sanctions, has become a technology leader that others need to work with. It also reminds us that in the tech world, even competitors depend on each other.
